1. Accepting these terms

These terms apply to this website, the Machado Method site for the United Kingdom. By using this site, you agree to them. If you do not agree, please do not use the site. Our Privacy Policy explains how we handle your personal information.

2. Who we are and what this site does

This site is run by the Machado Method Jiu-Jitsu (MMJJ) Association. The association is operated by Alliance of Divine Love Inc, Affiliate Chapel 2317, CMJJ Headquarters. “We” and “us” in these terms mean the association and the organisation that operates it. We are based in Texas, in the United States. Our address, phone number and email address are in section 15.

The association offers affiliation memberships to martial arts academy owners. Members get the Machado Method curriculum and training with Master Carlos Machado. This site describes the association and its three membership tiers, shows their prices, and lets you:

• book a call with the association director about joining;
• send us a question;
• give us your details when you join, on the onboarding form; and
• ask to cancel your membership, on the cancellation request form.

These terms cover this website only. They do not cover:

• the members’ area, where the lessons and the free courses are delivered;
• the Summit site at summit.machadomethod.com;
• the rank testing site at testing.machadomethod.com; or
• any other site we link to.

3. Who can use this site

You must be 18 or over to book a call, to join, or to send us a form. If you are under 18, a parent or guardian must fill in any form for you.

Association membership is for people who own or run a martial arts academy. When you join, you do so for your business.

4. Membership prices and payment

No purchases on this site. This site does not sell anything and does not take payments.

Published prices. Membership prices are shown per month, in US dollars, and that is the currency we bill in. Membership is month to month, with no yearly contract. The prices on this site are the association’s current prices, and we may change them.

Cancelling a membership. To cancel, fill in the membership cancellation request form. Cancelling takes 30 days’ written notice:

• Your membership stays active for 30 days from the day you send the form, unless you ask for a later end date.
• If you send the form less than 30 days before the end date you ask for, one final monthly payment is charged.
• When your membership ends, your access to the curriculum and other member resources ends too.

Refunds. Membership fees already paid are not refunded, unless we agree otherwise in writing or the law gives you a right to a refund.

Fees are not donations. Membership fees pay for the curriculum, training and services you receive. They are not donations and are not tax deductible.

Our Privacy Policy explains how we handle the details you give us when you book a call, join or cancel.

5. Using this site

You agree not to:

• give false information in a form or booking, or use someone else’s name;
• copy, download, share or resell the curriculum, videos, photos or text on this site, except as these terms allow;
• use the site to send spam, or to harass, threaten or mislead anyone;
• scrape, copy or collect data from the site with bots or other automated tools;
• try to break into, overload or disrupt the site, its forms or its host; or
• use the site in any way that breaks the law.

6. Our content and names

The Machado Method name, the association’s seal and logos, the curriculum, and the text, photos and videos on this site belong to us or to the people who license them to us. They are protected by copyright and trade mark law.

You may view the site and print a page for your own personal use. You may not copy, change, publish or sell our content, or use our names or logos, without our written permission. Official Academy is the membership tier that puts the Machado name on a member’s academy.

7. Links to other sites

This site links to other sites, including our own event, rank testing and members’ area sites, and sites run by other people. We do not control sites run by other people and are not responsible for their content or their privacy practices. A link is not an endorsement. Read the terms and privacy policy of any site you visit.

8. What we do and do not promise

We work to keep this site accurate and running, but we do not promise that it will always be available, free of errors, or up to date. We provide it as it is. To the extent the law allows, we give no other promises about the site.

Jiu-jitsu is a contact sport, and training carries a risk of injury. The information on this site is general. It does not replace in-person instruction from a qualified instructor.

9. Limits on our liability

Nothing in these terms limits or excludes our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• anything else that the law does not allow us to limit or exclude.

Subject to that, and to the extent the law allows:

• we are not liable for loss of profit, loss of business, loss of data, or any indirect or consequential loss that comes from your use of this site; and
• our total liability for any claim about this site is limited to the amount you paid us in the 12 months before the claim arose.

If you use this site as a consumer, and not for a business, you have legal rights that these terms do not take away. Nothing here affects them.

10. Your responsibility for misuse

If you misuse this site or break these terms, and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including reasonable legal costs.

11. Ending access

We may block or limit your access to this site if you break these terms or misuse the site. We may also decline a request to join. Sections 6, 8, 9, 10, 12 and 13 still apply after your access ends.

12. Texas law and courts

We are based in Texas. These terms are governed by the laws of the State of Texas, in the United States, and any claim about this site or these terms must be brought in the state or federal courts located in Dallas County, Texas. You and we agree to those courts’ jurisdiction.

If you use this site as a consumer, and not for a business, this section does not take away the protection of the laws of the country where you live that cannot be set aside by agreement. If you live in the United Kingdom, you may bring a claim in the courts of the part of the UK where you live.

13. Resolving a problem

If you have a problem with the site or with us, contact us first. Tell us what happened and what you would like us to do, and we will try to put it right with you. If we cannot resolve it together, either of us may take the matter to the courts named in section 12.

14. Changes to these terms

We may update these terms. When we do, we change the date at the top of this page. If you keep using the site after a change, you accept the updated terms. To see an earlier version, email [privacy email to be confirmed].
